Terms of Purchase for Buyers and Participants

  1. Scope and provider

These Terms and Conditions, Terms of Use and Terms of Sale apply to all online courses offered on teachr by the respective sellers, which are purchased via a Stripe Checkout order form and payment process. Purchase contracts between buyer and seller, which take place outside this ordering system are not part of this contract or contracts of teachr. Sellers of online courses provide additional terms and conditions, terms of use and conditions of withdrawal, which are bilaterally agreed and accepted.

To buy online courses, you must either be at least 18 years of age or be of legal age or older in the country where you reside and from which you wish to buy through teachr courses.

Contract language is English.

  1. Conclusion of contract

Our product presentation in teachr constitutes a request to conclude a contract for the paid use of an online course.

By clicking the button “Buy now” on the payment process in the checkout process of the payment provider stripe you conclude a contract with the seller and teachr for the use of an online course at the respective prices indicated

The prices quoted on our portal may include taxes, such as VAT, and other price components.

  1. Terms of Payment

We generally only accept Stripe payment methods. For payment processing and sending money to the seller, the payment service provider Stripe is integrated into teachr.

By using and connecting an account in teachr with Stripe, you agree to Stripe’s Terms of Service, Terms of Use, and Terms of Payment and Sale.

For correct payment processing, sales data, data on courses, user data, statistics and payment-related data (based on the privacy policy of teachr and Stripe) are transferred to Stripe. Further conditions can be found in the privacy policy of the payment provider Stripe.

  1. Payment account

A user account in teachr can be assigned to only one payment account. A user may be enrolled in or own multiple virtual campuses. A virtual campus refers to a learning environment that includes courses, users, participants, and collaborators, as well as learning content, data, and statistics. With this connection of a so-called linked Stripe account, teachr enables the storage of payment data of the service provider Stripe and the sending of funds through a payment and order form provided by Stripe and a payment account with Stripe. When the purchase contract is concluded, this payment account is created at Stripe and uniquely linked to the teachr user.

We are responsible for selecting the payment methods available in each case. In particular, we reserve the right to offer you only selected payment methods for payment.

The purchase of online courses is only possible with an instant payment method from Stripe. If you fall into arrears with a payment, you shall be obliged to pay the statutory interest on arrears at a rate of 5 percentage points above the prime rate. You will be charged a reminder fee of EUR 2.50 for each reminder sent to you after the default has occurred, unless lower or higher damages are proven in individual cases.

  1. Delivery

The delivery of the purchased online courses is done by providing access to it. Access is enabled immediately after the order and payment validation. The access can then be used by you for viewing the online courses.

Other online courses that were not otherwise part of the purchase process are not part of the offer. There is no claim to the sending of further accesses to similar and newer online courses of the provider.

It is your responsibility to have a suitable computer, browser, tablet computer, or smartphone ready to properly use the online courses. It can be written out of online courses. In this case, teachr retains the payment and purchase data according to the minimum legal requirements in countries, but at least 5 years through the service provider Stripe, to keep payments and uses of the online courses. In this case, only the statistical data on learning progress will be deleted after a period of time. Unless a payment is refunded, you may re-enroll in the online course without re-executing payment. Re-enrollment in the course is only possible for a refund if payment is made again. teachr reserves the right to charge the user reasonable refund costs if Refund requests repeat themselves at different campuses, online courses.

teachr provides course gifts free of charge through the print-on-demand service provider Printful on behalf of the instructor. These free gifts and rewards in a course are optional and not part of the actual course, but limited physical rewards. The entitlement to free gifts expires one year after enrollment in the course. Purchasing a course does not automatically entitle you to receive a course gift, nor are these gifts the actual product (online course). Course gifts may be out of stock and thus unavailable depending on demand and order status.

  1. Legal revocation instruction

You have a right of withdrawal in accordance with the following provisions:

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us, teachr by means of a clear statement (exclusively by e-mail or the refund form) of your decision to withdraw from this contract.

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. You can find the refund form at https://teachr.support Consequences of the withdrawal

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us or to teachr immediately and in any case no later than within fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days.

You bear the direct costs of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

End of the statutory cancellation policy

The right of withdrawal shall expire in the case of a contract for the supply of digital content not on a tangible medium if the Entrepreneur has commenced performance of the contract after the Consumer has expressly consented to the Entrepreneur commencing performance of the contract before the expiry of the withdrawal period and has confirmed his knowledge that, by giving his consent, he loses his right of withdrawal upon commencement of performance of the contract.

  1. Warranty and liability

Unless expressly agreed otherwise, your warranty claims are directed to the seller of the online courses in accordance with the statutory provisions of the law on sales. Unlimited liability: The seller of the online courses is liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act. We shall be liable for slight negligence in the event of damage resulting from injury to life, limb and health of persons.

In all other respects, the following limited liability shall apply: In the event of slight negligence, we shall only be liable in the event of a breach of a material contractual obligation, the fulfillment of which is a prerequisite for the proper performance of the contract and on the fulfillment of which you may regularly rely (cardinal obligation). The liability for slight negligence is limited to the amount of damages foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. This limitation of liability also applies in favor of the seller and our vicarious agents.

  1. Availability of content and online courses

teachr online courses have modules (building blocks) and functions. Not all modules will be available to all teachr users at all times and we are not obligated to make services or features available at all times, especially if those features utilize third party software. We reserve the right to block, change or remove functions and components and building blocks at any time and without prior notice.

You understand that no claim for reimbursement of expenses or damages can arise from this that would be declared justified due to lack of access to parts of the course.

teachr is not liable for the up-to-dateness of the courses and the course content and also not liable for any, especially disadvantages, misinformation, which can result from the use of learning content. The Campus Owner as seller of the online courses is obliged to keep his courses up to date and to constantly check them for function and correctness and to find new course elements or alternatives for the presentation of his course content if elements are no longer available.

teachr does not check the content of the courses in advance. Therefore, teachr has the discretion to block or remove courses, content, or building blocks under guidelines written in our Terms of Use, including if we determine, in our sole discretion, that content uploaded through teachr by the course author or campus owner violates our Terms of Use or Terms and Conditions of our integrated third-party providers. In this case, components of the online course or the entire online course may be deleted without notice. It is at teachr’s sole discretion to initiate a refund of the purchase price for the use or continued use of the online course. In particular, this is not possible if it is not possible to enforce a refund claim to the course author, campus owner as provider of the courses via the payment provider Stripe. In this case, the purchaser of the courses must inform the responsible course author in time and in adequate lead time about the shortcoming. If the latter reasonably fails to remedy the defect, legal action shall be directed exclusively to the Seller, but not to teachr.

teachr is not liable for any legal costs, lawsuit and court costs arising from legal disputes between the buyer and seller of the online courses. teachr reserves the right to charge legal costs in full to the party causing the costs arising from legal disputes of teachr LLC.

For validation and verification of an account ownership of the teachr account we reserve the right to request a validation via our provider Stripe Identity. To do this, we will have documents or a phone number validated to verify or verify the owner of an account.

These documents can be:

State identity card, passport

The last four digits of the deposited credit card

We reserve the right to block the account as well as to delete it after a period of 6 – 12 months or to transfer it to the rightful owner of the user account, if there are doubts about the ownership or a conflict remains unresolved.

  1. Duties

You agree that: Truthful information must be provided by you, in particular for the tax necessary to provide information for the country of origin to the seller, teachr and the payment service provider Stripe.

That online courses on teachr are not in any marketplace and that a purchase contract with implied declaration of intent concluded via teachr through a payment process and the order form of Stripe is exclusively between you and the seller. teachr only initiates the payment process, which is transferred from the buyer to the seller by Stripe.

teachr initiates an automated invoicing process on behalf of the campus owner, who alone is responsible for correct invoicing. If you notice any missing or incorrect information, you are obliged to notify the supplier or teachr of this error within 14 days (fourteen days) and ask for correction.

teachr clarifies that

The campus owner and payment account holder is solely responsible for compliance with legal regulations, consumer protection and revocation conditions for payment processing and provision of content, as well as accuracy of its information and content. teachr is not a dealer of the online courses offered.

  1. Payment terms and fees

teachr currently supports only the currencies Euro (€) and US Dollar ($).

teachr converts sales prices 1 to 1 without considering the conversion rate. The payment account provider will pay the difference in the conversion rate.

For clarification, a rate for 1 euro is equal to one U.S. dollar and is sold at that price. The specified currency depends on the buyer’s country of origin as well as his language settings or billing address.

teachr reserves the right to make unannounced adjustments to these fees at any time to compensate for any transaction fees, payment fees charged by the provider Stripe or to be charged by teachr for the service of initiating the payment transaction.

teachr currently supports only the countries available in Stripe (https://stripe.com/global) for receiving and sending payments.

  1. Taxes

teachr Campus holders and payment account holders are responsible for all taxes incurred through the sale of online courses. If teachr charges taxes, they will be calculated using the tax rates applicable to the billing address provided by the Buyer as the country of origin.

These amounts are in addition to payment amounts and fees and products charged to your authorized payment method. Tax exemptions must themselves be properly identified in invoices in accordance with applicable law.

teachr assumes no liability for improper invoicing by the provider.

  1. Refunds by participants and buyers

teachr does not usually offer refunds. However, if you submit a refund request via the teachr refund request form, teachr will consider at its sole discretion whether the justifications provided for this justify a refund. In the event of this being the case, teachr reserves the right to refund you the full purchase price and initiate a retransfer through the payment provider Stripe. teachr is not obliged to justify a decision for or against.

teachr reserves the right in special cases to charge any processing fees for refunds to the buyer and to temporarily or permanently block or remove the account without notice in case of repeated refund requests, if there is any doubt about the proper use of the online courses, or if there is a suspicion to obtain course content for free by temporarily accessing the online course. To clarify the deletion: the user will not be allowed to access any of his data or content on teachr, including the entire purchased online courses, in case of violation of the terms of payment, use and sale. An account cannot be restored. Refunds and refunds of payments already made are excluded.

The payment account and campus holder uses teachr and the online course sales systems at their own risk. teachr is not liable for payment failures or interruptions of the system, the availability of payments of any kind.

  1. Delimitation

teachr clarifies that in particular the payment provider Stripe may exclude, block or delete a connected Stripe Account at any time for reasons of violation of the Terms of Use. teachr cannot and will not be able to integrate alternative payment systems in this case for technical reasons, so that the purchase of online courses on teachr is only possible if a valid Stripe account is connected and properly obtained after compliance with all legal bases of tax and accounting obligations and all terms of use of Stripe.

  1. Copyright and rights of use

All online courses provided by us are protected by copyright. You acquire a temporary (period determined by the seller), simple, non-transferable right of use exclusively for non-commercial use. No exploitation rights are granted to you. In particular, you may not distribute, make publicly available or otherwise pass on to third parties the purchased online courses – either digitally or in printed form, in whole or in part. The right to reproduce is limited to acts of reproduction that are solely for the user’s own use. The granting of the rights of use by us to you is subject to the condition precedent of full payment of the purchase price.

We are entitled to individually personalize digital content made available for download with visible and invisible markings to enable the identification and legal prosecution of the original purchaser in the event of misuse. In the event of any unauthorized use of the Digital Content by the Buyer or any third party, the Buyer agrees to pay a penalty of $10,000 per infringing act.

  1. Final provisions

Should one or more provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.

Contracts between us and you shall be governed exclusively by the laws of the State of Delaware.

teachr reserves the right to change or delete portions of this Sales Agreement without notice, or to add additional terms at any time.
